§ 10-1-1. Power to regulate, set rates and charges, acquire utilities.

  • The council shall have power by ordinance to fix and regulate the price of gas and electricity, and to regulate and fix the fares, tolls and charges of wharves, public carriers and conveyances, whether transporting passengers, freight or baggage, and generally fix and regulate the rates, tolls and charges of all public utilities and to require uniform and satisfactory service. The right is hereby granted the city to acquire public utilities, such as gas or electric light works, and surface or underground systems for gas or for electric light or power, or otherwise used for transmitting any electric service. The right is hereby expressly granted to the city to regulate all public utilities and to require all persons or corporations to discharge the duties and undertakings for the performance of which the respective franchises were made. The rights conferred by this section shall not be construed as applying to any exclusive jurisdiction conferred upon the public service commission.
